Products are intended for personal use only unless we expressly agree otherwise in writing. We may refuse, cancel, or limit orders that appear to be placed for unauthorized resale, fraud, abuse, diversion, or other improper purposes.

4. Product Information

We make reasonable efforts to display product names, sizes, pricing, descriptions, notes, ingredients, images, availability, and other product information accurately. However, errors, omissions, supplier changes, photography differences, packaging updates, batch variations, or website issues may occur.

Fragrance descriptions are subjective. Notes, accords, concentration, longevity, projection, intensity, seasonality, gender descriptions, reviews, and artistic descriptions are provided for general informational purposes only and do not guarantee how a product will smell, perform, or react on your skin.

Product packaging may differ from website images. The product packaging, label, and included materials should be treated as the most current source of ingredient, warning, and use information.

5. Cosmetics, Ingredients, Allergies, and Safety

Fragrances and scented products may contain alcohol, fragrance compounds, essential oils, aroma chemicals, colourants, allergens, or other ingredients that may cause sensitivity, irritation, allergic reaction, or other adverse effects in some individuals.

Before using any product, you are responsible for reviewing the product label, packaging, ingredient list, warnings, and directions. Customers with allergies, sensitivities, medical conditions, pregnancy-related concerns, or ingredient restrictions should consult a qualified professional before use.

Unless otherwise stated by the manufacturer, fragrance and cosmetic products are for external use only. Do not ingest. Avoid contact with eyes, mucous membranes, broken skin, heat, open flame, sparks, and children. Discontinue use if irritation occurs.

Nothing on this website is medical, dermatological, therapeutic, or health advice. Products are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

6. Regulatory and Labelling Compliance

We aim to sell products that comply with applicable Canadian laws and regulations, including cosmetic labelling, ingredient disclosure, safety warnings, bilingual labelling, import, shipping, and consumer protection requirements where applicable.

Some products are imported, manufactured, labelled, packaged, or supplied by third-party brands or distributors. We may rely on suppliers, manufacturers, importers, and brand owners for product formulation, labelling, packaging, documentation, and regulatory information.

7. Orders

An order placed through the website is an offer to purchase the products in your cart. We reserve the right to accept, decline, cancel, or limit any order for any lawful reason, including:

  • product unavailability
  • pricing or description errors
  • payment issues
  • suspected fraud or unauthorized activity
  • shipping restrictions
  • regulatory restrictions
  • unusually large quantities
  • incorrect customer information
  • abuse of promotions or returns
  • supplier or inventory issues

Your order is accepted only when we issue an order confirmation or otherwise begin processing the order.

8. Order Confirmation and Contract Copy

After placing an order, you should receive an electronic confirmation containing key order details, including the products ordered, price, taxes, shipping charges, payment information, delivery information, customer information, and applicable policies.

Please review your confirmation carefully and contact us promptly if any information is incorrect.

9. Prices, Currency, Taxes, and Fees

Unless otherwise stated, prices are listed in Canadian dollars.

Applicable taxes, shipping charges, duties, customs charges, delivery fees, and other charges will be displayed or calculated at checkout where applicable. We do not intentionally advertise unattainable prices or hide mandatory fixed fees, except amounts that are imposed by law or calculated at checkout based on customer choices or location.

We may change prices, promotions, product availability, and shipping rates at any time without notice.

10. Pricing Errors

If a product is listed at an incorrect price or with incorrect information due to a website, typographical, supplier, system, or human error, we may correct the error, cancel the order, refund the amount paid, or contact you for instructions before proceeding.

11. Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.

Payments may be processed by third-party payment processors. We do not control all payment-processing decisions and may be required to cancel or hold an order where payment is declined, reversed, flagged, or suspected to be unauthorized.

12. Fraud Screening

We may use internal and third-party fraud-prevention tools to protect customers and our business. We may refuse, cancel, delay, or request verification for orders that appear suspicious, inconsistent, high-risk, or unauthorized.

13. Availability and Backorders

Products may be limited, seasonal, discontinued, delayed, allocated, or unavailable. Availability shown on the website is not guaranteed.

If an item becomes unavailable after you place an order, we may cancel that item and issue a refund, offer a replacement, offer a backorder option, or contact you with alternatives.

14. Promotions and Discount Codes

Promotions, discount codes, gifts with purchase, bundles, loyalty rewards, credits, and special offers are subject to their posted terms and may be changed, limited, suspended, or discontinued at any time.

Unless stated otherwise, promotions cannot be combined, transferred, redeemed for cash, applied to previous orders, or used after expiry.

We may refuse or cancel promotional benefits if we believe there has been misuse, technical error, fraud, or violation of promotional terms.

15. Shipping and Dangerous Goods (HAZMAT)

Shipping is governed by our Shipping Policy. Alcohol-based fragrances and fine perfumes are classified as flammable liquids / Dangerous Goods under transport regulations. Delivery timelines are estimates only unless expressly guaranteed in writing.

16. International Orders

If we offer international shipping, you are responsible for all import duties, taxes, customs charges, brokerage fees, import restrictions, and compliance with local laws unless we expressly state otherwise at checkout.

We may cancel orders that cannot be legally or reasonably shipped to the destination provided.

17. Risk of Loss and Delivered Packages

Subject to applicable consumer protection laws, risk of loss and title for products pass to you upon delivery of the items to the carrier. If your order is lost, damaged in transit, or marked as delivered but missing, please contact us promptly at info@ambere.co so we can assist in filing a claim with the carrier.

18. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return Policy. Because fragrance and cosmetic products are personal-use items, opened, sprayed, used, altered, or tampered-with products are strictly non-returnable unless defective or damaged upon arrival.

Return Shipping: Unless an item is defective or shipped in error by Ambère & Co., customers are responsible for all return shipping costs and insurance.

Restocking Fees: Eligible returns of unopened products in original condition may be subject to a handling or restocking fee of up to 10% of the item’s purchase price.

19. Gift Cards

Gift cards are governed by our Gift Card Terms. Gift cards are not redeemable for cash except where required by law. Purchased gift cards do not expire where prohibited by law.

20. Accounts

You may create a customer account for your convenience and to participate in any loyalty programs we offer. You are responsible for keeping your login information secure and notifying us promptly of any suspected unauthorized access.

We reserve the right to suspend, restrict, or terminate accounts, or cancel associated orders, where we have reasonable grounds to suspect fraudulent activity, unauthorized access, creation of multiple accounts to circumvent purchase limits, misuse of promotional or discount codes, unauthorized resale activity, or abuse of our payment and ordering systems.

Any such actions will be taken in accordance with applicable laws and will not affect customers’ statutory consumer protection rights.
